A Revocable Living Trust is the most common type we see in estate planning. It allows individuals, who we call grantors, to maintain control over their assets during their lifetime while also avoiding probate upon death. This means the assets transfer directly to designated beneficiaries according to the grantor’s wishes, saving time and expenses associated with probate court.
Moreover, a Revocable Living Trust provides privacy because the terms of the trust are not public record like a will. Consequently, this can be appealing to individuals who value discretion regarding their financial affairs.
The trust becomes irrevocable upon the grantor’s death, meaning its terms cannot be changed. Let’s say a client wants to ensure their children receive their inheritance but also have some guidance in managing it. We can incorporate provisions within the trust for staggered distributions or appoint a trustee with experience in financial matters.
