Steve: Probate primarily deals with assets solely owned by the decedent at their time of death. Consequently, assets held in trust or jointly owned with right of survivorship generally pass outside of probate.

For instance, a bank account jointly owned with a spouse would automatically transfer to the surviving spouse upon the other’s passing, bypassing the need for probate. Similarly, assets placed within a revocable living trust during the decedent’s lifetime are distributed according to the terms outlined in that trust document.

Conversely, assets solely owned by the deceased person, such as real estate, vehicles, or personal belongings, would typically become part of the probate process.

Determining ownership and whether the contents were subject to probate required careful analysis and legal counsel to ensure proper distribution according to the deceased’s wishes.
