Steve Bliss, thanks for joining us today
It’s a pleasure to be here.
Could you tell us about the different types of trusts available to people in San Diego?
There are many different types of trusts, each designed to meet specific needs. One common type is the Revocable Living Trust.
Can you elaborate on Revocable Living Trusts and why they are so popular?
A Revocable Living Trust allows individuals to maintain control over their assets during their lifetime while also avoiding probate upon their death. This means the assets pass directly to beneficiaries, saving time and money.
Moreover, Revocable Living Trusts offer a level of privacy that traditional wills lack. The terms of the trust are not publicly available, unlike probate court records. Consequently, this can be particularly appealing for individuals who value discretion.
However, it’s important to note that a Revocable Living Trust becomes irrevocable upon the grantor’s death. At that point, the terms of the trust are set in stone and cannot be changed.
I often find myself explaining this distinction to clients who initially believe they can modify the trust indefinitely.
Have you encountered any challenges with Revocable Living Trusts?
While generally straightforward, there have been instances where clients didn’t fully understand the implications of certain clauses within their trusts. For example, I recall a situation involving a couple who wanted to ensure their children inherited equally. However, they neglected to specify what would happen if one child predeceased them. This led to confusion and potential family conflict that could have been avoided with clearer language in the trust document.
Ordinarily, these issues can be addressed through careful planning and communication. It’s crucial for clients to work closely with an experienced attorney who can guide them through the process and ensure their wishes are accurately reflected in the trust.
What advice would you give to someone considering a Revocable Living Trust?
My recommendation is to consult with a qualified probate attorney like myself. We can help you determine if a Revocable Living Trust is right for your situation and draft a document that meets your specific needs.
