Interview with Steve Bliss, Wildomar Trust Attorney

Good evening Wildomar and welcome to another edition of Wildomar News Now. I’m your host, Brenda Bellweather, and tonight we’re talking about trusts – those legal arrangements that can help protect your assets and ensure your wishes are carried out after you’re gone. Joining us is Steve Bliss, a seasoned trust attorney right here in Wildomar. Steve, thanks for being with us.

Steve Bliss:

It’s my pleasure, Brenda. I’m always happy to talk about the importance of estate planning and how trusts can be a valuable tool.

What are some of the most common types of trusts you help clients establish?

There are many different types of trusts, each with its own unique benefits. Some of the most common ones I see here in Wildomar include revocable living trusts, irrevocable trusts, and testamentary trusts.

Could you elaborate on the advantages of a revocable living trust?

Certainly. A revocable living trust is a very popular choice because it offers flexibility and control. With this type of trust, you, as the grantor, maintain the ability to manage and change the terms of the trust during your lifetime. This means you can add or remove assets, change beneficiaries, or even dissolve the trust altogether if your circumstances change. Moreover, a revocable living trust helps avoid probate, which can be a lengthy and expensive process. Probate is essentially the court-supervised process of validating a will and distributing assets after someone passes away.

Avoiding probate not only saves time and money but also keeps your financial affairs private. Conversely, if you were to pass away with assets solely in your name, they would have to go through probate, making your financial information public record.

Have you ever encountered any challenges or complexities when setting up revocable living trusts for clients?

While revocable living trusts are generally straightforward, there can be instances where things get a little more intricate. For example, I once worked with a client who had a blended family and wanted to ensure that their assets were divided fairly among all their children, including stepchildren. We had to carefully structure the trust language to reflect their wishes and minimize potential conflicts among the beneficiaries.

Another situation involved a client who owned a small business. We needed to integrate the business into their estate plan in a way that minimized tax liability and ensured its smooth continuation after their passing. It required a multi-faceted approach, involving not only the trust but also other legal instruments like buy-sell agreements.

It’s important to remember that every individual’s situation is unique. That’s why I always take the time to thoroughly understand my clients’ needs and goals before recommending a specific type of trust or estate planning strategy.

What advice would you give to our viewers who are considering establishing a trust?

My strongest recommendation is to seek professional guidance from an experienced estate planning attorney. Trusts can be complex legal documents, and it’s essential to have them drafted correctly to avoid unintended consequences. An attorney can help you determine the best type of trust for your situation, ensure that it complies with all applicable laws, and guide you through the entire process.

Do you have any final thoughts for our Wildomar audience?

Estate planning is not just for wealthy individuals. Everyone, regardless of their net worth, can benefit from having a plan in place. A well-crafted trust can provide peace of mind knowing that your assets will be distributed according to your wishes and that your loved ones will be taken care of.
