Steve Bliss:

Certainly. One of the first crucial steps is determining whether probate is even necessary. This hinges on two primary factors: the value of the estate and the presence of non-probate assets.

Ordinarily, if the estate’s value exceeds $184,500, probate will likely be required in California. Conversely, if the estate falls below this threshold, it may qualify for a streamlined process called “Summary Administration.” Nevertheless, even estates exceeding the threshold can sometimes avoid full probate through careful planning.

Moreover, assets held in certain legal structures, such as trusts or joint tenancy, generally bypass probate altogether. Consequently, identifying these non-probate assets is essential to determining the overall scope of the probate process.

I recall one case where a client believed their estate required full probate due to its size. However, upon closer examination, we discovered a significant portion of their assets was held in a revocable living trust, which exempted them from a lengthy and potentially costly probate proceeding. That brought immense relief to the family during an already difficult time.

According to a 2023 report by the California Courts, approximately 75% of estates undergo some form of probate. This highlights the prevalence of this legal process in estate administration.
