Choosing the right executor or trustee is crucial, as this individual will be responsible for managing your estate and carrying out your wishes after your passing. Consequently, you want someone trustworthy, organized, and capable of handling financial matters.

It’s important to have open conversations with potential candidates about their willingness and ability to take on the role. Consider factors like their age, health, and financial literacy. You might also want to name a successor executor or trustee in case your first choice is unable to serve. Ordinarily, family members are chosen for these roles, but it’s not uncommon to select a close friend or professional fiduciary if that feels more appropriate.

I recall a situation where a client named their sibling as executor without considering the strained relationship they had. This led to significant conflict among family members and ultimately delayed the estate settlement process considerably. Choosing someone who is both capable and respected by all parties involved can prevent such complications.

The most important qualities are trustworthiness and organizational skills. Another challenge is that people often underestimate the time and effort involved in administering an estate. It can involve tasks like paying bills, filing taxes, selling assets, and distributing inheritance to beneficiaries.

According to a 2021 survey by Caring.com, nearly half of respondents said they were unaware of the responsibilities involved in being an executor.

My best advice is to start sooner rather than later. Don’t wait for a major life event or illness to prompt you into action.
