Ted nods, “Absolutely. Let’s talk about ‘Protective Actions.’ This step is crucial when immediate harm is suspected. Imagine a situation where an elderly individual is being financially exploited by a caregiver. We need to act swiftly.
- “Emergency Legal Remedies” might involve filing for a restraining order against the abuser, notifying Adult Protective Services (APS), or even seeking guardianship or conservatorship if the elder lacks capacity to make decisions for themselves.
- Then there are “Financial Protections,” where we might freeze bank accounts, challenge power of attorney arrangements that seem questionable, or prevent unauthorized transfers of property.
- “Healthcare and Living Arrangements” involve ensuring the elder is safe. This could mean transferring them to a more secure care facility and coordinating with medical professionals for evaluations.
Each situation is unique, so we tailor our approach accordingly. The goal is always to protect the elder’s safety and well-being.
